What is Medical Malpractice?

Medical malpractice refers to mistakes made
by a medical professional that has caused harm or injury to the patient.  The word comes from the Latin, with “mal” referring to something bad and literally meaning “bad practice.”


Medical malpractice occurs when a physician or other medical professional fails to provide appropriate care when compared to the care another physician would provide under the same circumstances. 

There is a lot of confusion about what constitutes medical malpractice and many people think because their doctor keeps them waiting in the waiting room or doesn’t return their phone calls they are guilty of malpractice.  Specifically malpractice has to result in serious injury or death for it to rise to the level of criminal or civil malpractice that can result in monetary damages.
